​ הצהרת צולל

     *     אני מצהיר בזאת כי אני צולל בעל רישיון וביטוח צלילה בתוקף. עם הידע, היכולת והמצב
     הבריאותי הנדרש לעסוק בפעילויות צלילה מגוונות ) להלן: "פעילות צלילה" או " פעילות
     הצלילה" ( ואני מתחייב לצלול לפי כל כללי הבטיחות אותם למדתי וזכורים לי היטב.
     ידוע לי שהעומק המירבי שמותר לי לצלול הוא: כוכב אחד\WATER OPEN, עומק של 20
     מטר. צולל שני כוכבים\W.O.A, עומק של 30 מטר. צולל שלושה כוכבים DM עומק של 42
     מטר.

     *     המועדון רשאי להשכיר ציוד לחצי יום.
        השכרת ציוד לחצי יום היא בין השעות 8:00-12:00 או 12:00 .17:00-
        אי הגעה לפעילות בלי הודעה מוקדמת שהיא 24 שעות מראש תחויב במחיר מלא.
     *     אני מבין ומודע לכך שאם אטביע את הווסת אקנס בסך 25 .₪
     *    בדקתי את הציוד שקיבלתי ומצאתי אותו תקין ומתאים במלאו לצרכי פעילות הצלילה ואני
           מצהיר שהציוד ששכרתי הינו לשימושי האישי בלבד.
           אני מתחייב להחזיר את כל הציוד במצב תקין כפי שקיבלתי אותו ולשאת בכל נזק ו\או אובדן
           של ציוד צלילה.
           המפעיל לא יהיה אחראי לכל אובדן או נזק לחפצי האישיים או ציוד אשר הושאר בחצרו של
          המפעיל או תחת שליטתו.
    *       אני מאשר בזאת ומודע לכך וקיבלתי את כל האינפורמציה הרלוונטית אודות הסיכונים
         הטמונים בפעילות צלילה. ידוע לי ואני מבין שצלילה עם מיכלי אוויר דחוס כרוכה בסיכונים
         ממשים.
         פעילות צלילה במים פתוחים יכולה להתקיים באתרים מרוחקים, בזמן ו\או במרחק מבית
        חולים או תא לחץ. אני לוקח על עצמי, באופן אישי, את כל הסיכונים הנצפים ובלתי נצפים
        בקשר עם פעילות הצלילה לגבי כל נזק, פגיעה, הפסד שעלולים להתרחש לי ו\או לרכושי
        כתוצאה מהשתתפותי בפעילות הצלילה.
    *     אני מודע באופן מלא לאפשרות העדרו של תא לחץ בסמוך לאתר הצלילה, עובדה זו
        והפגיעה ממנה אני עלול לסבול בעטיה, נלקחו על ידי בחשבון והנני מצהיר על נכונותי
        להמשיך בפעילות הצלילה.

     *   אני מבין ומסכים ש "יש צלילה בע"מ" \ "אקווה ספורט" מרכז צלילה לים סוף בע"מ,
          פקידיה, מדריכיה, עובדיה ועובדים אחרים או קבלנים עצמאיים )כולם ביחד או לחוד לעיל
          ולהלן: "המפעיל "(, לא יהיו אחראיים לכל אובדן, פגיעה או הפסד שיגרם לי ו\או לאחרים
          כתוצאה מהשתתפותי בפעילות הצלילה, גם אם ניתן היה לצפות או הפגיעה ו\או הנזק.
         אני מודע שהאובדן, הפגיעה או ההפסד שאני עלול לסבול מהם יכול ויהיו מהותיים ועלולים
         לגרום פגיעה גופנית, זמנית או קבועה ואפילו למוות.
   *    אני משחרר בזאת את המפעיל מכל אחראיות בקשר לכל פעולה או מחדל שנעשו על ידם
         בפעילות הצלילה, שגרמו לי ו\או לרכושי אובדן ו\או פגיעה ו\או הפסד.אני מתחייב לשפות
         את המפעיל ולדאוג לכך שהמפעיל לא יפגע בכל דרך שהיא במקרה של תביעה שהוגשה
         על ידי ו\או משפחתי ו\או אפוטרופסי ו\או יורשיי ו\או עזבוני כתוצאה מהשתתפותי בפעילות הצלילה.
     *     עם השתתפותי בפעילות הצלילה, יהפוך כתב ויתור ושחרור זה לסופי, בלתי ניתן לשינוי ו\או
         לביטול. הוא יחייב את משפחתי ו\או אפוטרופסי ו\או יורשיי ו\או כל מי שיבוא מיקומם ו\או
         מטעמם.
     *      אני מצהיר ששפת האם שלי היא עברית, ו\או שקראתי מסמך זה בשפת האם שלי ו\או
           בשפה שאני מבין במלואה.
      *        אני מבין כי התנאים המפורטים בכתב ויתור ושחרור זה הם חוזיים וחתמתי על כתב ויתור
          ושחרור זה הם תנאי מקדמי למפעיל לשתף אותי בפעילות הצלילה.
          קראתי את תוכנו של מסמך זה בזהירות, הבנתי את תוכנו והשלכותיו וחתמתי על מסמך זה
           מרצוני החופשי.
       *      הריני לאשר שימוש בכרטיס האשראי אותו נתתי לפיקדון לכל פעילות שבוצעה על ידי ו\או
            על ידי שאר הרשומים במעטפה.

 

Diver's Declaration

• 
   * I hereby declare that I am a certified diver with a valid diving license and
  insurance. I possess the necessary knowledge, ability, and physical condition
  required to engage in various diving activities (hereinafter: "Diving Activity"
  or "the Diving Activity"), and I undertake to dive in accordance with all the
  safety rules I have learned and remember well.
  I am aware that the maximum depth I am permitted to dive is as follows:
  One-star diver / Open Water Diver: up to 20 meters. Two-star diver / A.O.W:
  up to 30 meters. Three-star diver / DM: up to 42 meters.
•  * The diving club is authorized to rent equipment for half a day.

Half-day equipment rental is available between 08:00–12:00 or 12:00–17:00.
Failure to arrive for the activity without prior notice of at least 24 hours will
result in a full charge.

•  I understand and acknowledge that if I submerge the regulator in water, I will be fined 25 NIS.

•  I have inspected the equipment I received and found it to be in proper

condition and fully suitable for my diving activities. I declare that the rented

equipment is for my personal use only.

I undertake to return all equipment in the same condition in which I received it

and to bear the cost of any damage and/or loss of diving equipment.

The operator shall not be responsible for any loss or damage to my personal

belongings or any equipment left on the operator’s premises or under their

control.

•  I hereby acknowledge and confirm that I have received all relevant

information regarding the risks involved in diving activities. I am aware and

understand that diving with compressed air tanks involves real risks.

Open water diving may take place at remote sites, at a distance from a hospital

or a hyperbaric chamber. I personally assume all foreseeable and

unforeseeable risks associated with diving activities, including any damage,

injury, or loss that may occur to me and/or my property as a result of my

participation in the diving activity.

I am fully aware that a hyperbaric chamber may not be available near the dive

site. I have considered this fact and the potential harm I may suffer due to it

and declare my willingness to proceed with the diving activity

•  I understand and agree that "Yes Scuba Ltd" / "Aqua Sport" Red Sea Diving

Center Ltd., its officers, instructors, employees, and other workers or

independent contractors (collectively or separately, hereinafter: "the

Operator"), shall not be liable for any loss, injury, or damage incurred by me

and/or others as a result of my participation in the diving activity, even if such

injury and/or damage was foreseeable.

I acknowledge that any loss, injury, or damage I may suffer could be

significant and may result in temporary or permanent bodily harm and even

death.

I hereby release the Operator from any liability concerning any act or omission

on their part during the diving activity that caused me and/or my property loss

and/or injury and/or damage.

I undertake to indemnify the Operator and ensure that they do not suffer any

harm in the event of a claim filed by me and/or my family and/or my guardian

and/or my heirs and/or my estate as a result of my participation in the diving

activity.

By participating in the diving activity, this waiver and release shall become

final, irrevocable, and binding upon my family and/or guardian and/or heirs

and/or any successor or representative on my behalf.

•  I declare that my native language is Hebrew and/or that I have read this

document in my native language and/or in a language I fully understand.

•  I understand that the terms specified in this waiver and release are contractual,

and signing this document is a prerequisite for the Operator to allow me to

participate in the diving activity.

I have carefully read this document, understood its contents and implications,

and signed it of my own free will.

•  I hereby authorize the use of the credit card I provided as a deposit for any

activity carried out by me and/or by any other individuals registered under my

name in this agreement.
